Öz/Abstract

Bu çalışmada, Rawls’un Bir Adalet Teorisi adlı eseri analiz edilecek ve bu eserin faydacılığa karşı gerçekte nasıl bir alternatif teori olarak sunulduğu incelenecektir. Yapılan tartışmada Rawls’un faydacılığa alternatif bir teori kurduğunu iddia etmesine rağmen, gerçekte faydacılığı tamamıyla reddetmediği, sadece onu yetersiz gördüğü ve bu yetersizliği de adalet ilkelerinden biri olan fark ilkesi ile kapatmaya çalıştığı iddia edilecektir. Teleolojik bir yapıya sahip olan faydacılık, yapılan eylemin hangi niyetle yapıldığına değil, eylemin sonucunda getirdiği faydaya yoğunlaşmaktadır. Kendisine hak yerine iyi olanı temel alan faydacılık, toplumun faydasına olan bir yaşama vurgu yapar. Rawls, faydacılığa karşı insanı kendinde amaç olarak gören Kantçı ilkeye yöneldiğini iddia eder. Bu anlamda Rawls’a göre faydacılık, toplumda özgürlük ve hakların dağılımında eşitsizliklere yol açmaktadır. Faydacılığın bireysel farklılıklara yer vermemesi en önemli sorundur. Rawls, söylemlerinde her insanın farklı olduğunu ve herkesin kendi iyisi olabileceği düşüncesinin faydacılık tarafından göz ardı edildiğini vurgular ve buna göre de kendi hakkaniyet olarak adalet teorisini yapılandırır.

In this study, it is analysed why emerged Rawls’s theory of justice and it is examined how he presented an alternative justice theory against Utilitarianism. This study is claim that although he claimed that he established an alternative theory, he did not reject utilitarianism in his theory completely. Indeed, he only saw it insufficient and he tried to close this insufficiency through the difference principle. Utilitarianism which is teleological focuses on an advantage which is done in the result of an act, not intention. Utilitarianism, which takes being good itself instead of being right, emphasises to a life which includes the happiness of society. Rawls claims that he heads to Kantian principle which sees the human being as in the self-purpose. According to Rawls, utilitarianism causes inequality in the distribution of rights and freedoms in society. The most important problem is that utilitarianism does not include the individual differences. Rawls emphasises that every individual is different from each other and everyone has their own good but utilitarianism never see them and according to this situation he established his own justice theory.
